LEASING, CASH REGISTERS, EXPENDITURE ESTIMATES: PARLIAMENT HAS DECISIONED ON 15 AGENDA ISSUES

Sukhum. September 29, 2021. Apsnypress. On Wednesday, September 29, a session of the Parliament took place. The agenda included 15 issues.

The MPs adopted the draft law "On financial leasing" in the first reading.

In the third, final reading, the bill "On the use of cash registers in the Republic of Abkhazia".

The Parliament canceled resolutions of Presidium of the RA Supreme Court "On the regulation of storage, accounting and execution of firearms, ammunition and military equipment" dated January 14, 1994 and "On the approval of the Regulation on the order of firearms" dated May 4, 1994 and declared them invalid. This decision was taken in connection with the adoption of the RA Law "On Weapons" dated December 30, 2020, as well as in order to eliminate contradictions and ensure the uniformity of legal regulation in the field of arms circulation.

The deputies gave their consent to the Cabinet of Ministers to transfer a land plot with an area of 12 hectares in the village of Adzyubzha, Ochamchira region from the category of "agricultural land" to the category of "industrial land". The land plot will be provided by Aqua-Agro-Industrial Complex Zolotoy Bereg LLC for construction of a complex of buildings for production of pectin and processing of mussels and oysters.

The Cabinet of Ministers also agreed to transfer a land plot with an area of 0.93 hectares from the category of "agricultural land" to the category of "recreational land" on the territory of the unitary enterprise "Gagripsh" in Gagra.

The MPs approved the resolution of the Cabinet of Ministers "On the inclusion of the property complex of the Kavkaz boarding house in  Gagra in the list of objects subject to privatization and approval of conditions for its privatization.

There was made a decision to form a working group to develop legislation in the field of health care and population policy.

The working group headed by chairman of the parliamentary committee on social policy, labor, health care, demography and affairs of veterans and war invalids Alkhas Dzhindzholia includes 11 people. Among them are MP Almaskhan Bartsyts, lawyers from Presidential Office and Office of the Cabinet of Ministers, Ministry of Health and State Committee for Repatriation.

The MPs adopted amendments to some legislative acts of Abkhazia in terms of administrative offenses in the field of customs.

The document was represented by permanent representative of President in the Parliament Saida Butba.

"President, in order to exercise his right to legislative initiatives, introduced to the Parliament a bill on amendments to some legislative acts in terms of administrative offenses in the field of customs. It is proposed to amend three codes - the Code of Administrative Offenses, the Customs Code and the Code on Judicial Proceedings in Cases of Administrative Offenses. The need to amend these codes is due to the fact that today there are a number of contradictions between the norms establishing administrative responsibility in the field of customs, enshrined in the Code of Administrative Offenses and in the Customs Code, ” Saida Butba said.

The presented draft law is aimed at establishing new structures of administrative offenses for violation of the RA customs legislation, as well as eliminating the corresponding contradictions.

A number of issues on the agenda sparked an emotional discussion.

The deputies did not approve the budget estimate of the Ombudsman's Office for 2022 in the amount of 5,409,965 thousand rubles. In the estimate proposed for consideration, the budget of the ombudsman's office was increased by 500 thousand rubles compared to 2021. At the same time, no explanations were given regarding the rejection of the estimate by the deputies.

At the same time, the deputies accused Asida Shakryl of not submitting to parliament a report on the activities of the Ombudsman's Office for 2020. To this, Shakryl replied: “The report on the activities of the Ombudsman for 2020 was presented to Parliament on March 10, 2021. From this day on, I am waiting for an invitation to speak to the deputies and report for 2020 ”.

The amount of funds for the maintenance of the Control Chamber of the Republic of Abkhazia for 2022 was not approved either. In accordance with the draft document, 34,744,900 rubles were provided for the Control Chamber.

MP Alkhas Dzhindzholia inquired about the increase in the estimate.

“The increase in the estimate was mainly due to the increase in the remuneration fund for the employees of the Chamber, which I think is quite justified,” said Chairman of the Control Chamber Robert Arshba.

He also drew the attention of the deputies to the problem of premises for the accommodation of employees.

“The Control Chamber has existed for 8 years. And the issue of accommodating its employees has not been resolved yet. The staff of the Chamber is 52 people and they need normal working conditions. 18 people can be said to be sitting on concrete. Such working conditions are unacceptable. This year, it was decided to move, if there is such an opportunity, to new premises, ” Arshba said.

The Control Chamber rents premises in the building of one of the town's former schools.

Three issues were removed from the agenda: “On Amendments to the RA Constitutional Law“ On Repatriates ”; RA draft law “On the RA State Extra-budgetary Fund for Repatriation and Demography”; RA draft law “On Amendments to Certain Legislative Acts of RA”.

The Permanent Representative of President in the Parliament Saida Butba spoke about the essence and expediency of making changes to these documents.

“At one of the last sessions, a draft law on demographic policy was adopted in the first reading, where it was indicated that financing of activities in the field of demography would be carried out not only from the budget, but also from the Fund for Repatriation and Demography.

In addition, to date, the funds of the Repatriation Fund are also sent ex post to finance activities in the field of demography. Therefore, the proposed changes are related to reorganization and change in the legal status of the Repatriation Fund. Now the funds of the fund will be directed not only to the program in the field of repatriation, but also to events in the field of demography, respectively, the name of the repatriation fund is losing its significance, now it will be called the Fund for Repatriation and Demography. It is proposed to amend the Constitutional Law "On Repatriates" in terms of the name and legal status of the fund, " she said.

In addition, in connection with the renaming of the fund, it is proposed to amend the legislative acts that determine the sources of the fund's income.

MP Alkhas Dzhindzholia noted that in previous years, when the budgets of the repatriation fund were discussed, execution stemmed from the lack of cost planning. By adopting a number of these regulations, the State Committee will be required to have a clear program of expenditures.

The MPs proposed to remove the issues from the agenda and once again discuss them in more detail at the next session.
